Kevin Soucek is an attorney with the Walter Haverfield Business Services Group, focusing his work on transactional matters, tax matters, and trademark law.

Kevin counsels business owners and individuals in a diverse range of tax, corporate, non-profit, and estate planning and probate matters to meet clients’ goals related to theirtax and non-tax objectives. He assists in matters involving strategic tax planning for closely held businesses, mergers and acquisitions, conversions of entities, and restructuring transactions. Kevin also handles a variety of state and local tax issues including tax audits and appeals.

Kevin is experienced in strategically handling various aspects of intellectual property law primarily with respect to both U.S. and foreign trademark prosecution as well as maintenance and enforcement in varied client industries. He frequently represents clients in trademark opposition and cancellation
proceedings, as well as in many trademark settlements, among otherintellectual property-specific litigation.

EXPERIENCE

TAX EXPERIENCE

  • Represents clients in a variety of estate planning matters, including, but not limited to, the creation of dynastic trusts, business succession planning, asset protection and charitable foundations
  • Advises in designing creative and strategic tax structures to minimize or reduce income tax exposure
  • Manages tax audits and appeals, abatement requests, and other tax controversies
  • Counsels clients, from a tax perspective, regarding entity classification structures and on certain tax treatment for potential transactions
  • Assists in designing equity-based compensation incentive plans
  • Consults and handles matters in estate and wealth planning, and facilitates estate and trust administration

INTELLECTUAL PROPERTY EXPERIENCE

  • Prosecutes trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board of the USPTO
  • Prepares and negotiates various consent and/or co-existence agreements; settlement agreements
  • Prosecutes trademark applications and renewals
  • Assists in trademark and patent infringement litigation trial teams
  • Prepares website privacy policies and terms of use
  • Provides counsel relative to acquisition of domain names
  • Addresses various domain name and social media account matters, as well as Amazon Brand Registry issues
